Journal Entry:
“Slept in. Got up at 7:50 AM. Crazy, happens once in a while. Working on Journal, Walking Distance, but my mind was on the motion. Big push so I can: A) Get it done by Thursday. B) Type it up (Mail a copy home). C) Think about and work on SOMETHING ELSE. D) Mail one to Steve with a letter.
Skipped, or I guess slept through, BREAKFAST.
LUNCH: Tuna, so I took the alternative that included three-bean salad (kind of gross) and Lasagna (left over, still good). I secured a piece of bread for reserve.
After Lunch, I worked on the Motion, researching some options and cases to back my arguments.
DINNER: Chili, wasn’t bad, white rice.
So we lost the TVs due to another cell phone being found, till Wednesday, so that puts a damper on ‘You’re in my Seat’ for a couple of days. Not that I was doing much, but I’ll get there. Prison Stories, full movie reviews, but for now my case takes precedence.
Went outside, hung out with H.L. Worked on Motion till bed. Can’t. Stop. Now.”
Notes for Day 69 (Four Years Later)
Extremely abbreviated entry. It was more like a ‘To-Do’ list. You could tell I was deep diving into the law library, and legal thoughts/cases were consuming just about every ounce of brain power I had (which isn’t much, but at least I was trying). And while, in retrospect, it did take away from my creative writing, it was all part of the process of my legal self-training. I poured my heart and soul into that first motion, which ended up being a motion to vacate.
But as I learned more, while I may have raised some good points, there would have been no way it would have gone anywhere. You’ve heard the saying, “Laughed out of Court.” Had I actually filed it, the Judge would have had a good laugh, and that’s the best-case scenario. He may have accepted it as a 2255 and then denied it. That would seriously hurt my future chances of appeal. In other words, I was still very ignorant of the process, which is very important.
But if I can find a final copy (which I finished on a typewriter, because the printer always had issues, and it was a constant fight), I will publish it here if anyone wants a laugh. Actually, it will show the start of my growth as a Jailhouse Lawyer.
