On Day 61, I found my new obsession: pretextual prosecution. Meanwhile, a story idea about A.I., billionaires, and the emancipation of the incarcerated begins to form.

Journal Entry:


“An emergency count at 5:47 AM was my wake-up call. An emergency count, which can happen anytime twenty-four hours a day, meant we had to be standing in the ‘doorway’ of our CubiCell quietly until the count was completed. Went to breakfast; dark and dreary outside. Remnants of a passing storm, or the beginning of one?

BREAKFAST: Oatmeal or cream of something, Cinnamon roll. Ate some.

The library is still locked, so my writing will have to start in the common area; it’s the only place with any light. Worked on Outer Justice. Spent some time in the law library this morning researching PRETEXTUAL PROSECUTION. Most cases are shut down by the appeal courts, and very few make it that far to begin with. Several have to do with immigration and the claims that if the defendant is returned to their original country, they will be subjected to Pretextual Prosecutions by their Government. Not all have been shut down; some were accepted. I will list what I find here:

BRUNCH: Pancakes, syrup, potato cube corners, hard-boiled eggs (Put one in reserve, cautiously).

Got my first PDFU -Derivative Idea** (Based on the 1930 film of the same name, Abraham Lincoln). Bram Link-Con 2030. A fantasy/sci-fi/satire about two captains of tech/industry, Trillionaires, and their bizarre arch-rivalry that spans decades. The final showdown is when one of them, Elon Lincoln, ‘creates’ a personality from his deceased or near-deceased son. The new offspring becomes the front runner for the President of the U.S.A. He promises to emancipate the only remaining legal slavery in the U.S.A.: The Incarcerated. This would be a major transmutative ordeal for the country and may set off a Civil War. But Lincoln’s arch-enemy, Will Connoly, who was once a former partner, will lose a fortune he has built with a sprawling Private Prison System.

Wrote most of the day off and on. Went and helped J.K. with the plasticware. ‘E’ made a terrific chicken-cheese wrap—real restaurant quality stuff. He said he learned how to do it in prison from an Italian guy. I could only eat half; I’ll finish later. Got to stop eating so much. When I start walking again, it will be different.

SUPPER: Hamburger-like glob (did not eat), Noodles with gravy (ate some), Green beans (ate), bread (reserve).

Wrote some more. Sent journal pages and M.D.O.L. paperwork home for safe-keeping. Did a little more law library, which made me realize something: The Berg/French case vs. my case. The U.S. Government used the Trademark Infringement Investigation to ply a guilty plea out of Berg for hiding the immigrant workers who worked in the Pot Operation in his barn. So, in that way, Berg was ‘involved’ in the French Case. The difference with my case is that the copyright charge is all they have. I have ZERO connection with the WTR. And that is the D.O.J.’s fear in revealing the J.T. Indictment (Sealed), because then their motives for my case will be revealed.”



Notes for Day 61 (Four Years Later)

Standard day book-ended by two major ideas/thoughts. This was the first day (of many) when I dove deep into the Law Library. Just so you know: The Law Library in federal prison isn't a bunch of old dusty law books (though there are some there); it is an old-style, I’d say 1990s-era interface with LEXIS NEXIS, which is updated somewhat regularly—maybe every six months. It was a good thing it was free to use, or I would have racked up thousands of dollars. I eventually was on there every moment possible. But this is when I was realizing the very real possible reality of the PRETEXTUAL nature of the first-of-its-kind Criminal Case that had dominated my life for the last five years. My mind was spinning with ways, if not to prove it in Court, but at least to find a way to reveal it as truth and not be discounted as a conspiracy-theory fueled bitter convicted convict. Because, quite frankly, I wasn’t, and I am still not, bitter or holding any grudges with anyone involved in my case.

On the other end was the short story idea, Bram Link-Con 2030. I am still not sure where that title came from. I wanted to make a modern update, totally fictional version of the public domain film Abraham Lincoln, which I watched right before self-surrendering. I think it is a great film and has a lot of relevance today. The interesting thing: remember the date of this journal (2021), before AI became mainstream and before Elon Musk entered any political arenas. I wish I had written more on it, but I believe that little synopsis is it. Maybe someday, I’ll finish the thought and the story. Since the idea was conceived while I was incarcerated, it will qualify for my Shadows: Stories I Wrote in Prison book.
