Day 93 was all about change: my days of boredom shifted into intensive service dog training, and my graduation from passive client to 'jailhouse lawyer' was complete.
Day 93 was all about change: my days of boredom shifted into intensive service dog training, and my graduation from passive client to 'jailhouse lawyer' was complete.

Journal Entry:

"Mixed sleep, then had trouble getting up for 1st day of dog training, tentatively. Didn’t do any writing; in fact, 12:20 before I start the journal.

They let me in the dog class, not sure if I’ll stay, I want to do it. I think it would be fun, something to do and challenging. It’s puppies! Bonus! Was late for cup day but no one said anything yet... Maybe I’ll go crash for a bit. Still drag ass tired.

LUNCH: Bone-in chicken, green beans, sweet potato cubes, 2 choc chip cookies that size were the best part of the meal but I gave mine to Buddy the 'Fuck You' Guy.

Did a little C. copyright research, worked on King letter, if decided to take my time with that, really do a good job, then repackage it for Prof. Larry and maybe an article/general statement.

SUPPER: CK cubes, creamed corn, black beans, wh rice, 2 wraps, a wrap and cubes went into reserve.

Must do 2 laps, restart walking pledge. Wahoo! Did 3, that means I do 4 tomorrow. Got an email from the debarment woman, I think I am going to do a light appeal to the situation. I have 3 months to think about it. When I get the 3 documents I will look then over and decide. I like the Pros/Cons approach."

Letter Draft: To Steve (9/23/21)

"Thank you for your reply concerning the debarment. In addition to whatever written materials you have concerning my direct appeal, could you please also send me (via snail mail) the transcript for my sentencing (I never received them and they were not available on PACER before I self-surrendered).

  1. Jury instructions from the Trial.

Also please put Special Mail - D. Thank you in advance for these documents and your hard work on the appeal. I look forward to hearing from you. — Doug"

Notes for Day 93 (Four Years Later)

  • The End of the Passive Client: Looking back at the draft letter to Steve, I think he sensed that my days as a passive client were over. I was finally demanding the actual records of my own case—sentencing transcripts and jury instructions—that should have been in my hands years prior. I planned on pushing him until he dropped me, but he wouldn't; he likely wanted to maintain control of the appeals so his own conflict of interest and lackluster representation wouldn't be revealed by a new set of eyes.

  • The Puppy Pivot: Day 93 marks the start of the service dog training program, which became the highlight of my time at Devens. I had initially thought you needed to be there for a long time or pass a rigid test to be trusted with a dog, but COVID had ravaged the program’s volunteer numbers. When a fellow inmate got in, I decided to just "show up" as C.C. suggested. I learned a lot more than just dog training in that class.

  • Allies and Lessons: This was where I met E.D., a stand-offish guy from a major corporation who would eventually become a close friend and ally. His story was a reminder that I wasn't the only one "wronged by the government." He was the only person I met at Devens who truly shouldn't have been in prison for a single day, let alone the 10+ years he was serving.

  • The Advocacy Re-Packaging: Even with the excitement of the puppies, the legal fight remained central. I was already planning how to turn the Senator Angus King letter into a general statement for Professor Larry (Lessig), refining the "Orphan Works" argument as I gained fresh insight into the case.
